The appellant, David Mahone, was found guilty by a jury upon a charge of murder in the second degree. He was sentenced to a term of 40 years in the State Penitentiary. On this appeal he does not question the sufficiency of the evidence to support the finding of the jury that he killed the deceased, William Marche. The only issue at the trial was raised by appellants testimony that the killed in self-defense.
