On July 31, 1980, David M. Williams was convicted of sexual assault in the first degree, AS 11.41.410(a)(1), assault in the second degree, AS 11.41.210(a)(2), and kidnapping, AS 11.41.300 (a)(1)(e). On October 6, 1980, he was sentenced to twenty years on the charge of kidnapping, with five years suspended, ten years on the charge of sexual assault in the first degree, and five years on the charge of assault in the second degree, all running concurrently. Williams raises three issues on appeal: (1) his right to due process violated when the trial court admitted evidence of a photographic lineup made at a time when he was in custody; (2) the trial court erred when it refused to give defendants proposed jury instruction that eyewitness identification testimony should be viewed with caution; and (3) his sentence was excessive.
