This appeal concerns denial of attorneys fees to the prevailing defendant in a tort action which arose out of an automobile collision. David Miller, defendant and appellant, obtained a jury verdict in his favor in this suit brought by Maurine and Richard McManus. He moved for an award of attorneys fees pursuant to Civil Rule 82. The affidavit of his counsel stated merely the total number of hours spent, his hourly rate, and the amount claimed; it did not itemize the manner in which the time had been spent. In entering judgment, the trial Judge also entered an order denying the motion for attorneys fees, stating that:
